Jailer misconduct case settled

Fourteen women who claimed they were the victims of sexual misconduct perpetrated by former Truckee jailer Bobby Rutledge have settled with the county for $960,000, according to Nevada County Counsel Charles McKee.

McKee said the county’s $100,000 insurance deductible covered part of the cost, with the California State Association of Counties picking up the rest. The county is a member of CSAC, which has a pool of liability money to help counties control insurance costs.

Auburn lawyer Pat Little, who represented the 14 plaintiffs, said the settlements were reached over a four-month period, and some women received more money than others.

Rutledge, now an inmate at Mule Creek State Prison in Ione, was convicted in 1999 of sexual battery or misconduct against women inmates between April and August 1997. The allegations included illegal strip searches and fondling.

The women sued the county and Rutledge for violating the women’s rights to reasonable search and seizure. The county was supposed to have a woman official on hand but didn’t, and Little said that would have deterred Rutledge.

“It was a very gender-biased county. If you’re a man, OK. If you’re a woman, look out because there wasn’t a policy on how to handle the fairer sex,” he said.

The county has since installed surveillance cameras at the jail and started following new procedures.
