Lawsuit filed over Coldstream well

The proposed Coldstream Water Facility may face further delays.

Mountain Area Preservation Foundation has filed a lawsuit under the California Environmental Quality Act on the grounds that an environmental impact report should have been required for the project, and that the business violates federal law which governs the Truckee River Basin under the Truckee River Operating Agreement.

Placer County Board of Supervisors overruled appeals Feb. 27 filed by the Preservation Foundation and the California Department of Parks and Recreation over the conditional use permit.

“We think there should be a full EIR and we think there are significant environmental impacts that have not been mitigated,” said Stefanie Olivieri, spokeswoman for the Preservation Foundation.

The planned commercial water extraction business will sell bottled spring water off-site.

The property in Coldstream Canyon is comprised of more than 26 acres and is surrounded by state park land and protected areas.

The Coldstream Water Facility could result in as many as 5,400 truck trips per year through portions of Donner Memorial State Park, which surrounds the entrance to the property.

Placer County representatives feel the mitigated measures are sufficient and that the federal law which governs the Truckee River Basin won’t take effect until the Truckee River Operating Agreement is complete.
