Rape alleged at Donner party

A Bay Area man was charged in Nevada County Superior Court Monday with three felony counts related to an alleged sexual assault at a Donner Lake party.

Shane Clark Morgan, 23, of Concord, Calif., sat with his head bowed as Judge C. Anders Holmer described the severity of the charges brought against him.

According to Deputy District Attorney Kathryn Francis, a 20-year-old woman said she was drunk and passed out about 4:30 a.m. Sunday at a party in a private Donner Lake residence when the sexual assault occurred.

The victim told investigators she woke up and told the suspect to stop, but he did not. According to court evidence, a witness was present at the time.

Judge Holmer set bail at $25,000 and scheduled a bail hearing for Tuesday morning.

The suspect’s family owns a second home at Donner Lake. After Monday’s arraignment, the suspect’s mother, Coleen Morgan, told Deputy District Attorney William Cornell that her son is innocent and that she does not have bail.

“It’s a horrible mistake ” one-hundred percent,” Mrs. Morgan said. “I know my son and it was consensual.”

Morgan’s next court date is at 9 a.m. Aug. 27.
