TRPA to sue Caltrans over guardrail color

Sun News ServiceKINGS BEACH – The Tahoe Regional Planning Agency’s lead attorney was granted authority by the agency to sue Caltrans for installing a guardrail that doesn’t meet TRPA standards.Attorney John Marshall was given the go ahead by the TRPA board to file a lawsuit against Caltrans in case the agency needs that authority.”This is a last option for us,” said Julie Regan, TRPA communications director. “The agency really hopes to work this out with Caltrans without needing any kind of litigation.” In October, Caltrans installed shiny, acid-etched guardrail instead of rustrail, which is brown in color, along state Route 267, that runs between Kings Beach and Truckee.”It seems like it’s a cost issue and we’re trying to work through that with Caltrans,” Regan said.Caltrans has appealed the TRPA requirement. Regan said the agency hopes to resolve the issue within the next several weeks.The appeal will be heard at the TRPA’s December governing board meeting. A Caltrans spokesperson was unavailable for comment.
