Opinion: Correct dates for California SB 277 vaccine forms
I would like to thank Dr. Chris Arth for his opinion letter published Sept. 23, “Comments on marijuana and vaccines.”
Unfortunately he is misinformed as to the deadline date, under the law for PBEs to be filed and accepted for the current and continued grade span beginning school year 2016-2017.

Here is the pertinent text as it relates to SB 277 and acceptance of CDPH form 8262 by school districts, adopted under AB2109:
“SB-277 Public health: vaccinations.(2015-2016), SEC. 2. Section 120335 of the Health and Safety Code is amended to read: 120335. (g) (1) A pupil who, prior to January 1, 2016, submitted a letter or affidavit on file at a private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center stating beliefs opposed to immunization shall be allowed enrollment to any private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center within the state until the pupil enrolls in the next grade span.”
Many school districts have a deadline of Sept. 30, 2015 for kindergarten or other physicals to complete registrations for this school year.
However, with regard solely to the law and compliance with the filing of CDPH form 8262 for your child’s standing through their current “grade span” and to the next checkpoint, that filing deadline is “prior to January 1, 2016.” This applies primarily to 2nd through 5th graders who did not file the new form during Kindergarten entry prior to school year 2014.
If your child only had the old blue form on file, that form will not apply to the new law, as it is not a “letter or affidavit.” For those children who are missing any of the vaccines on the list, any booster shots or are on any type of alternative/delayed schedule, you must file a personal letter or submit CDPH form 8262 “affidavit” to your child’s school prior to January 1, 2016.
